Senate and House pass significant consumer protection bills


SB 328 & 386 cornerstones of Democrats’ commitment to consumer protection

SALEM – Both chambers claimed a major victory this morning with passage of Senate Bill 386 and Senate Bill 328. As key pieces of their ongoing commitment to protect Oregonians by strengthening consumer protection laws and enforcement, SB 386 and SB 328 add certain tactics used by some debt collectors to the Unlawful Debt Collection Practices Act.


SB 328, which was passed by the House, will give the Attorney General authority to pursue legal action against debt collectors who use unlawful practices such as threatening arrest, using obscene language, or attempting to collect interest or fees in excess of the actual debt.

“This bill is a long overdue remedy for consumers harmed by unscrupulous debt collection practices,” said Representative Paul Holvey (D-Eugene). “SB 328 creates a much needed enforcement mechanism to help put a stop to these methods.”

Attorney General John Kroger applauded the passage of SB 328, which will now go to the Governor’s desk for his signature.

"It's time to hold illegal debt collectors accountable," said Kroger. "Once signed by the governor, the Oregon Department of Justice will vigorously enforce this important new law."

SB 386 contains two main pieces that protect Oregonians from unscrupulous debt collectors. First, it prohibits debt collectors from attempting to or threatening to collect debt that the collector knows does not exist. Second, SB 386 prohibits collectors from making false or misleading statements when they are collecting debts.

“There has been a proliferation of debt collectors out there who sue first and ask questions later,” said Senator Suzanne Bonamici (D- NE Washington Co. & NW Multnomah Co.), sponsor of the bill in the Senate. “These unscrupulous debt collectors are preying on our most vulnerable citizens, especially seniors. The legislation we passed today will level the playing field so these Oregonians are protected.”

Oregon faces the most challenging economic times in generations. Senate and House Democrats have made protecting Oregon families a top priority this session.

“This legislation builds on our strong record for standing up for Oregonians who are being unfairly targeted,” said Senate Majority Leader Richard Devlin (D-Tualatin). “Especially when families are trying to make ends meet, they deserve protections from these predatory debt collectors.”

“House Democrats are dedicated to protecting families struggling in this crisis,” said House Majority Leader Mary Nolan (D-Portland). “Tough times demand strong leadership. These bills are part of that effort.”

SB 328 now goes to the Governor’s desk for his approval. SB 386 now moves to the House for consideration.
